Terms of Service

Draft pending legal review. These terms describe how Ghost is intended to operate. They have not yet been reviewed by counsel, and entity and pricing details are still to be confirmed.

1. The agreement

These terms are between you (and the company you represent) and Superman Services, which operates Ghost. By creating an account or using Ghost, you accept them. If you are agreeing on behalf of a company, you confirm you are authorised to bind it.

2. What Ghost does

Ghost reads data from the third-party accounts you connect — your phone system, ad platforms and field service software — and presents it as reporting on calls, leads, agent performance and marketing return. Where you enable it, Ghost also sends conversion data back to an ad platform you have connected.

3. Your account

  • You must give accurate registration details and keep them current.
  • You are responsible for what happens under your credentials. Keep them secret, and tell us promptly if you think they have been compromised.
  • You must be at least 16 and legally able to enter into a contract.
  • Account owners are responsible for the colleagues they invite and the access they grant them.

4. Connected accounts

You are responsible for having the right to connect each third-party account and to authorise us to read from it. Your use of those services remains governed by your agreements with them; we are not a party to those, and we are not responsible if a provider changes its API, restricts access, or goes down.

You may disconnect any integration at any time. Doing so stops collection and destroys the stored credential, but it does not by itself delete data already gathered — see the deletion instructions.

5. Your data stays yours

You keep all rights in the data you connect and everything derived from it for you. You grant us a limited licence to host, process and display that data solely to operate Ghost for you and to keep it secure. We do not sell it, and we do not use it to train models. We may use aggregated, de-identified statistics that cannot be traced back to you or your customers to improve the product.

6. Acceptable use

You agree not to:

  • break the law, or infringe anyone’s rights, using Ghost;
  • connect data you have no right to connect, including personal information you have not lawfully collected;
  • attempt to access another customer’s data, or probe, scan or test our systems without written permission;
  • resell, sublicense or white-label Ghost without our agreement;
  • use automated means to overload the service or circumvent rate limits.

7. Availability and support

We aim to keep Ghost available and accurate, but it is provided without an uptime guarantee unless we have signed a separate agreement with you saying otherwise. Reporting depends on third-party data: if a provider is delayed, incomplete or wrong, the figures we show will inherit that.

8. Reporting is not advice

Ghost produces analytics to inform your decisions. It is not financial, accounting, tax or legal advice, and the figures are not a substitute for your books of record. You are responsible for the decisions you make with it, including how you spend on advertising.

9. Fees

Paid plans are billed in advance on the cycle shown at checkout, in Canadian dollars unless stated otherwise, and are exclusive of taxes. Fees are non-refundable except where the law requires otherwise. We will give at least 30 days’ notice before a price change takes effect on your account.

10. Ending the agreement

You may close your account at any time from Settings. We may suspend or terminate an account that breaches these terms, that creates a security or legal risk, or that has not paid. On termination your access ends and your data is handled as described in the Privacy Policy. Export anything you need first.

11. Disclaimer

Except where the law does not allow it, Ghost is provided “as is”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted or error-free.

12. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability arising out of these terms is limited to the amount you paid us in the twelve months before the claim arose. Nothing here limits liability that cannot lawfully be limited.

13. Indemnity

You will defend and indemnify us against claims arising from your data, your use of Ghost in breach of these terms, or your breach of the law.

14. Changes

We may update these terms. If a change materially affects you, we will email the account owner at least 30 days before it takes effect. Continuing to use Ghost after that means you accept the change.

15. Governing law

These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. The courts of British Columbia have exclusive jurisdiction, without prejudice to any mandatory consumer protections in your own country.
